SUpost Terms of Service

These Terms of Service ("Terms") govern your access to and use of SUpost websites, applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and Account Responsibility
You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter this agreement. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.
You are responsible for all activity under your account and for maintaining the confidentiality of your credentials.
2. Changes to These Terms
We may update these Terms from time to time. Material updates will be posted on this page and reflected by a revised Effective Date. Your continued use of the Service after changes become effective means you accept the updated Terms.
3. The Service
SUpost provides online resources including classifieds, forums, messaging, and related services. We may modify, suspend, or discontinue any part of the Service at any time, to the extent permitted by law.
4. User Content
You are solely responsible for content you post, upload, send, or otherwise make available through the Service ("User Content").
You retain ownership of your User Content. You grant SUpost a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, display, distribute, and otherwise use your User Content as necessary to operate, maintain, improve, and provide the Service.
You represent and warrant that:
- You have the rights required to submit and license your User Content.
- Your User Content does not violate applicable law or third-party rights.
- Your User Content is not fraudulent, defamatory, infringing, or otherwise unlawful.
5. Prohibited Conduct
You agree not to:
- Violate any law, regulation, or third-party rights.
- Post unlawful, fraudulent, deceptive, defamatory, hateful, exploitative, or harassing content.
- Post malware or code intended to disrupt systems.
- Impersonate others or misrepresent affiliation.
- Collect personal data without lawful basis or required consent.
- Send spam or unauthorized commercial communications.
- Use bots, scrapers, crawlers, or automated tools to access or collect Service data without written authorization.
- Interfere with the security, availability, or integrity of the Service.
- Bypass moderation, technical controls, or access restrictions.
- Post or promote illegal goods, services, or activities.
6. Moderation and Enforcement
We may, in our reasonable discretion, monitor, review, remove, reject, re-categorize, limit visibility of, or disable content or accounts that violate these Terms, applicable law, or create risk to users or the Service.
7. Paid Services, Subscriptions, and Auto-Renewal
Some features require payment. By purchasing paid features, you agree to the pricing and billing terms shown at checkout.
For recurring subscriptions (including Job Posts):
- Charges recur automatically until canceled.
- You authorize us to charge your selected payment method for recurring fees and applicable taxes.
- You can cancel at any time at https://members.supost.com/#manage.
- Cancellation applies to future billing periods unless required otherwise by law.
- Except where required by law, fees are non-refundable.
Current Job Post pricing (unless otherwise stated at purchase): $75.00 per post, billed weekly.
8. Intellectual Property
The Service, excluding User Content, is owned by SUpost or its licensors and protected by U.S. and international intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Service.
9. Third-Party Services
The Service may link to third-party websites or services. We do not control and are not responsible for third-party services, content, privacy practices, or terms.
10. Copyright Policy (DMCA)
If you believe content infringes your copyright, send a notice to:

Your notice should include identification of the copyrighted work, the allegedly infringing material, your contact information, a good-faith statement, a perjury statement, and your physical or electronic signature.
11. Privacy
Your use of the Service is also governed by our Privacy Policy at https://supost.com/privacy.
12. Termination
We may suspend or terminate access to the Service if we reasonably believe you violated these Terms, applicable law, or created risk to users or SUpost. You may stop using the Service at any time.
13. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, or that the Service will be uninterrupted, error-free, or secure.
14. Limitation of Liability
To the maximum extent permitted by law, SUpost and its affiliates, officers, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or revenue.
To the maximum extent permitted by law, SUpost's total liability for all claims arising out of or related to the Service will not exceed the greater of (A) the amount you paid SUpost in the 12 months before the event giving rise to the claim, or (B) USD $100.
15. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless SUpost and its affiliates, officers, directors, employees, agents, and service providers from and against third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.
16. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Unless prohibited by law, disputes will be resolved exclusively in state or federal courts located in San Francisco County, California. Either party may bring qualifying claims in small claims court.
17. Electronic Communications
You consent to receive notices and communications from us electronically, including by email, account notices, or postings on the Service.
18. General
- These Terms and the Privacy Policy form the entire agreement between you and SUpost regarding the Service.
- If a provision is held unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any provision is not a waiver.
- You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or asset sale.
- Nothing in these Terms limits rights that cannot be waived under applicable law.
